Programme Member – a natural person, online customer of UAB Uoga Uoga who purchases products and is a member of the UAB Uoga Uoga Loyalty Programme.
Company – UAB Uoga Uoga, Company Code 302642608, VAT Payer’s Code LT100006547014, registered office at 4 Riterių Str., Vilnius, LT-08248, Lithuania.
Loyalty Programme – the Loyalty Programme offered by the Company and governed by these Terms & Conditions.
Loyalty Points – virtual loyalty points awarded for purchases made through the Company’s online shop and credited to the individual Account; the points can be used by the Programme Member to purchase the Company’s products at a discount price.
Account – a personal account created on the Company’s website https://uogauoga.lt and providing the Programme Member with information on their participation in the Loyalty Programme, allowing the Programme Member to manage their personal data, access information on accumulated Loyalty Points, etc.
Personal Data – information on the Programme Member which is processed by the Company in accordance with section “Processing Personal Data” of the Loyalty Programme’s Terms and Conditions.
Terms and Conditions – the terms and conditions of this Loyalty Programme.
This Loyalty Programme is designed to provide benefits and added value to both the Programme Members and the Company.
The Loyalty Programme facilitates:
The Company reserves the right to partially or completely modify these Terms and Conditions, suspend or terminate the Loyalty Programme by giving advance notice of 10 calendar days on the Company’s website and (or) by communicating this to Programme Members via their Accounts or e-mail.
The Loyalty Programme is open to natural persons aged 14 (fourteen) and older.
Eligible individuals are required to set up an Account on the Company’s website https://uogauoga.lt and register for the Loyalty Programme.
In order to register for the Loyalty Programme, eligible individuals are required to provide their personal details and familiarise themselves with the Terms and Conditions. By familiarising themselves with the Terms & Conditions, the individual agrees to comply with them.
Upon providing their personal data and expressing their wish to join the Loyalty Programme, the individual receives an e-mail request from the Company to confirm registration with the Loyalty Programme.
Upon confirming their enrolment in the Loyalty Programme, the individual receives an e-card with a QR code. The number on the e-card is the individual’s telephone number.
Enrolment in the Loyalty Programme is considered complete when the individual receives an e-mail from the Company confirming registration and including their e-card with the QR code.
You will be accumulating loyalty points by purchasing products on the Company’s website. The full amount spent will be converted into loyalty points: 1 euro = 1 point (cents are excluded).
Loyalty points are not awarded for purchasing gift cards or for calculated delivery charges.
For every 100 loyalty points earned a 5 EUR discount voucher is automatically generated and emailed to the Programme Member. The generated discount voucher is valid for 6 months.
The discount voucher can be redeemed on purchases worth 30 EUR and over.
The discount voucher is also valid when purchasing discounted products. The discount voucher cannot be used to cover delivery charges or buy gift cards.
Once the discount voucher is generated, the loyalty points are deducted in the Loyalty Programme.
Discount vouchers can be used for making purchases online and in physical shops.
To redeem the discount voucher in a physical shop, the Programme Member needs to present the voucher code to the shop assistant who will enter it in the register.
To redeem the discount voucher online, the voucher code needs to be entered in Step 4 of the payment process.
If the Programme Member wishes to be congratulated on their birthday and awarded a birthday discount, they can provide their birth date in the Loyalty Programme.
The birthday discount is awarded to the Programme Member one week before their birthday, when a one-off 15 % discount voucher is automatically generated and emailed to the Programme Member. The Programme Member has two weeks to redeem their birthday discount voucher (one week prior to the birthday and one week after).
The birthday discount cannot be used together with other promotions and cannot be redeemed on product sets or products which are already discounted.
The Programme Member commits to provide their personal details correctly and in full. Individuals who do not provide mandatory personal details may not participate in the Loyalty Programme. If there is a change to originally provided personal details, the Programme Member must inform the Company and update their personal details in their Account or by contacting the Company via the e-mail provided in these Terms.
When participating in the Loyalty Programme, the Programme Member does not have the right to:
The Programme Member must keep their Account log-in details safe and not disclose them to unauthorised third parties.
The Programme Member is liable for any actions performed or completed while using the Account. If a third person is using the Account, it is considered that the Programme Member is using the Account, except cases where another individual is, in accordance with applicable regulations, found to have used or is using these objects without the knowledge of the Programme Member.
Upon discovering that their Account log-in details have become known to third persons, the Programme Member must instantly change the password used to log in to their Account or notify the Company.
The Programme Member takes full responsibility for any inappropriate or illegitimate use of their Account or data, including cases when the Account is used by third persons, if sections 22 and 27 of these Terms and Conditions are not complied with.
Upon receiving a notification that the log-in details of the Account have been compromised, the Company has the right to block the Account. The Company will endeavour to prevent any further illegitimate use of the Account but is not liable for the loss of log-in detail confidentiality if it occurs through no fault of the Company. The Company is not liable for any damages, losses or inconvenience suffered by the Programme Member or third persons which were caused by the disclosure, loss or illegitimate use of the Programme Member’s log-in details.
Membership of the Loyalty Programme terminates:
After terminating the membership of the Loyalty Programme, any discount vouchers can be redeemed before their expiry date.
In order to register the Programme Member for the Loyalty programme, create an account for them, provide the benefits outlined in these Terms, and organise its activities in line with the needs and expectations of its customers, the Company processes the Programme Members’ personal data.
The Company confirms that personal data is handled according to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (further – Regulation (EU) 2016/679), the Republic of Lithuania Law on Legal Protection of Personal Data, other regulations and instructions of supervising institutions.
Sources of personal data
The Company receives personal data from the Programme Members who submit them to the Company directly when registering for the Loyalty Programme, purchasing products and (or) redeeming discount vouchers across the Company’s shops.
Purpose and legal basis for processing personal data
Based on the legal bases outlined, personal data is processed for the following purposes:
The Company may process personal data for other purposes, if it is required in order for the Company’s activities to be compliant with applicable regulations.
Processed personal data
The Company processes the following personal data: telephone number, e-mail address, password, date and time of Account creation and (or) log-in, actions performed within the Account, details (QR code, card number) of the e-cards awarded, information on purchased goods and awarded loyalty points, information on discount vouchers presented, their expiry dates and details of redeeming.
Receivers of personal data
The Company provides personal data or facilitates access to the Company’s employees who are involved in the administration of the Loyalty Programme and to providers of services such as maintenance and administration of the IT infrastructure and software, maintenance of the website and web hosting, electronic communications, auditing, legal, consulting and others.
If required, for the purpose of protecting its rights and legitimate interests, the Company may share personal data with courts or other institutions responsible for dispute resolution.
Personal data shall not be shared with other third parties, except when the Company is obliged by law to provide personal details.
Duration of storing personal data
Personal data is stored for the duration of Loyalty Programme membership. If, at the point of terminating their membership in the Loyalty Programme, the individual has access to a valid discount voucher, their personal data shall be stored until the expiry date of the discount voucher or until the date the afore-mentioned voucher is redeemed.
Data subject rights and exercising these rights
Programme Members have the following data subject rights which the Company exercises in compliance with the terms and extent of Regulation (EU) 2016/679 and other applicable legal acts:
Programme Members may forward their requests to exercise the afore-mentioned rights and any complaints/notifications/requests regarding the processing of personal data to the Company using the contact details provided in these Terms & Conditions or contact the Company’s responsible data protection officer on [email protected].
The rights of the data subject will be exercised upon verification of the Programme Member’s identity. The Programme Member can verify their identity by submitting a request with their personal data through their Account or from the e-mail address provided when registering for the Loyalty Programme, or in any other way which proves to the Company that the request comes from the data subject. Should the data provided in the request be insufficient to unambiguously determine the Programme Member’s identity, the Company may ask for additional details necessary for identification.
The Company shall respond to the request no later than one month after receiving the request. In exceptional circumstances, depending on the complexity and number of requests received, the period may be extended by two further months and the data subject will be informed of this extension.
Right to lodge a complaint
If the Programme Member is not satisfied with how the data subject rights are exercised or it is considered that that the legal acts regulating personal data and (or) privacy protection have been infringed, the Programme Member has the right to lodge a complaint with the State Data Protection Inspectorate, contact details on https://vdai.lrv.lt/, or with a supervisory authority in another Member State which is the Programme Member’s habitual residence or place of employment. In all cases, we ask you to contact the Company before lodging a complaint so that we can find the most suitable solution together.
The Company reserves the right to modify the conditions and benefits of the Loyalty Programme, to correct or supplement these Terms at any point. Information on any changes to the Loyalty Programme and (or) Terms and Conditions will be published on the Company website https://uogauoga.lt, within the Account and, if necessary, using other means of information dissemination.
If the Programme Member does not agree with the changes to Terms and Conditions, the Programme Member has the right to terminate their participation in the Loyalty Programme. Failure to exercise the right to terminate participation in the Loyalty Programme before the changes in Terms come into force shall be considered as the Programme Member’s agreement with these changes.
All rights which are not specifically assigned to the Programme Member by these Terms are reserved for the Company.
Should any of the points in these Terms become invalid, it will not affect the validity and enforcement of the remaining points of the Terms. Any invalid, illegitimate or unenforceable point is considered void.
All disputes regarding compliance with these Terms shall be resolved through negotiation. Should the parties fail to reach an agreement, disputes shall be settled in accordance with the legal acts of the Republic of Lithuania. The relationships created on the basis of these Terms are governed by the law of the Republic of Lithuania.
